PERSONAL INJURY AND AUTOMOBILE ACCIDENTS

Auto and Boating Accidents-Many personal injuries result from motor vehicle accidents, such as car accidents, motorcycle accidents, or boating accidents. Accidents may involve negligence on the part of drivers, including drunk driving and reckless behavior. Dog Bite Attacks-Georgia has specific laws governing the care and restraint of domestic pets. If you have been injured by an animal, you may have claims against the pet's owner. Please contact our firm for assistance and advice.

Incidents Involving Horses-Georgia has specific laws regarding accidents involving horses. Although there are immunity laws in Georgia which may prevent certain individuals and/or entities from being sued for certain accidents involving horses, there are limitations to these immunity laws which may permit a lawsuit against these individuals and/or entities. Although property must accept the natural runoff of water from neighboring lands, an artificial increase or concentration of water discharge may give rise to a cause of action. Tort Claims-A Tort, broadly speaking, is a civil wrong or injury, other than a breach of contract, for which the court will provide a remedy in the form of an action for damages. Tort Claims include claims for negligence (a breach of a duty that causes damages), intentional torts against the person (assault, battery, false imprisonment, intentional infliction of emotional distress), intentional torts against property (trespass to land, trespass to chattels (personal property), conversion), strict liability (liability without fault), nuisance (a defendant's interference with a plaintiff's interests (the invasion, that is the hurt, annoyance or inconvenience of a person's interests)), misrepresentation or fraud, defamation (slander and libel), invasions of the right of privacy, misuse of legal procedure (malicious prosecution, wrongful civil proceedings, abuse of process, abusive litigation pursuant to Title 51, Chapter 7, Article 5 of the Official Code of Georgia Annotated), interference with commercial or economic relations (injurious falsehood, interference with contractual relations, interference with prospective advantage), domestic relations torts (including loss of consortium (the loss of services, society, and affection of a spouse due to the defendant's conduct)), and wrongful death and survival actions (in general, a wrongful death action is a claim or cause of action in favor of a representative and for the benefit of certain designated persons, usually those most likely to have suffered a loss for the victim's death; in general, a survival action is a claim or cause of action held by the decedent immediately before or at death, now transferred to his personal representative). Damages in tort claims may include compensatory damages (damages to compensate for the injury), general damages, special damages, incidental damages, and punitive damages (punitive damages are damages to punish the tortfeasor/defendant and are in addition to other damages). Equitable Relief may also be obtained in certain cases (equitable relief includes injunctions and restraining orders). Premises Liability-Often people are injured due to a defect on someone's property. Medical Malpractice- We represent individuals who have died or suffered extensive injuries resulting from negligence of a hospital, physician, nurse practitioner, or other health care provider. Catastrophic cases may arise from a primary care doctor's failure to diagnose diseases, such as cancer, or failure to refer patients to an appropriate medical specialist, a baby who dies or is permanently maimed, and patients who are sent home from the emergency room with inadequate treatment.
