What You Should Know About Getting a Protective Order

In Georgia, there are certain steps that are followed in a proceeding for a protective order. First, a threat of bodily harm must have occurred. The victim can go to the superior court and get an ex parte order — a legal order granted even without the alleged aggressor being there. At this point, the judge can order a temporary protective order (TPO).

Temporary protective orders are very powerful documents. If one is ordered, the aggressor can be forcibly removed from a shared home and made to pay child support.

While many domestic violence protective orders are necessary and legitimate, they are sometimes used unfairly to gain leverage in a divorce, so it is critical that you work with an attorney who understands the long-term implications of legal action today.

After 30 days, the court holds another hearing. At the hearing, the judge can order a more permanent protective order good for a year. At any point before this yearlong protective order expires, it can be extended or even made permanent.
